Web Info Session on the new General Product Safety Regulation
The Technical Regulations Division within the MCCAA yesterday held an online information session on the new General Product Safety Regulation (GPSR). The session aimed to inform stakeholders about the key changes introduced by this important piece of legislation and to promote a common understanding of the obligations it establishes.
Inġ. Rudie Vella, Director General of the Technical Regulations Division, emphasised that the ultimate objective of the GPSR is to ensure that consumers are only offered safe products. He noted that this should be a shared goal among all those involved – authorities, consumers, economic operators, and professionals in the field. Inġ. Vella also underlined the importance of ensuring that all actors in the supply chain are adequately informed about their responsibilities, as this is essential to achieving compliance with the Regulation.
The session also featured contributions from key senior officials within the MCCAA. Ms Ingrid Borg, Director for Regulatory Affairs, and Ms Bernice Farrugia, Director of Market Surveillance, both addressed participants, offering insights into the broader regulatory framework and the Authority’s enforcement priorities under the GPSR. Their interventions underscored MCCAA’s commitment to working closely with stakeholders and strengthening product safety oversight. Technical presentations were delivered by Mr Matthew Curmi and Mr Charles Tanti, who provided practical guidance on specific obligations and the operational implications of the new Regulation.
Participants were informed that the GPSR replaces the General Product Safety Directive and introduces a number of significant changes. While the Regulation primarily applies to consumer products, it also covers products intended exclusively for professional use that may ultimately reach the consumer market. It complements sector-specific safety legislation by addressing risks and requirements not otherwise covered.
Particular emphasis was placed on the importance of maintaining product traceability and technical documentation. Stakeholders were reminded that all actors in the supply chain have a duty to ensure traceability, especially when products are found to be unsafe and corrective actions must be taken – whether voluntarily by the responsible economic operator or as mandated by the Technical Regulations Division. Additionally, manufacturers are required to compile and retain technical documentation that identifies potential risks associated with their products and make this documentation available throughout the supply chain for the period defined in the Regulation.
The Regulation introduces several key changes affecting both economic operators and authorities. These include a broader product scope, including products that incorporate new technologies; a stronger emphasis on risk assessment throughout the product lifecycle; increased accountability for economic operators; enhanced market surveillance through additional enforcement powers; and improved consumer protection through the introduction of remedy rights in the event of product recalls.
